The prosecution’s case in the Lodi terror imam trial is under assault, in large part because of the Zawahiri claim mentioned (skeptically) here.

A defense lawyer on Tuesday aimed to undercut the credibility of an FBI informant and critical witness in the trial of two Lodi men charged with terrorist connections.

The informant acknowledged to Griffin on Tuesday that the FBI originally contacted him in Oregon about a multimillion-dollar money-laundering scheme, but he denied he was a suspect in that investigation.

On the same occasion, Khan testified, he offered his services to the FBI and told the agents he had seen Osama bin Laden’s top adviser at the mosque in Lodi on numerous occasions when he was living there.

Ayman al-Zawahri is known to the FBI as bin Laden’s personal physician and al-Qaida’s second-in-command.

I’m not even addressing whether or not the Zawahiri stuff is true—you have to see this from the standpoint of a juror. All of Khan’s other claims might have stood up to the smell test, if he hadn’t also claimed to have seen Zawahiri at that mosque. That would have an impact on a juror’s openness to attempts to impeach Khan’s credibility. I can’t imagine the Zawahiri claim being material to the case, so why did the prosecutors allow it into evidence?

It may not lead to outright acquittal, but if so much of the case depends on this Khan guy it’s not out of the question.

The “Hillary Beats Cheney” item below was the first item in last night’s Brit Hume “Grapevine” segment as found online. This one is the last item from that same segment:

In a memo to employees last week, CEO Jim Clifton praised the past relationship with CNN, but said “it is not the right alignment for our future,” adding, “CNN has far fewer viewers than it did in the past, and we feel that our brand was getting lost and diluted.”

But CNN is calling the memo “unprofessional” and “in every respect untrue,” saying Clifton told CNN he was ending the partnership because “the CNN brand was so dominant that Gallup wasn’t getting the attention for the polls that they wanted.”

We’re doomed: Hillary would win against Big Dick Cheney if the 2008 November election were held in March 2006.

But in general election matchups, Senator Clinton runs well behind Giuliani and McCain — losing 51 percent to 39 percent against Giuliani and 50 percent to 39 percent against McCain. In fact, the New York Senator comes out on top only against Vice President Cheney, whose approval number in the most recent Fox News poll is 35 percent.

Microsoft the Merciful

Once upon a time, I actually thought Microsoft should come out with new operating systems on schedule. But having downloaded and used Internet Explorer 7’s first public beta, I’d just as soon they keep tinkering with “Vista” until they get it right.

Microsoft Corp. will delay the consumer release of its new Windows operating system until January 2007, missing the holiday sales season and throwing some PC makers and retailers into turmoil.

The delay in Windows Vista — caused by Microsoft needing more time to enhance security and other functions — will come as a blow to Microsoft partners who were looking forward to a new operating system to boost holiday sales.

Windows Vista is Microsoft’s first major update to the company’s flagship operating system since Windows XP was released in late 2001.

Via Rand, the Ten Most Annoying Alarm Clocks. Pretty clever, but #2 wouldn’t be very effective with me, I’m afraid.

The Sonic Alarm will wake pretty well anything up. Simply pull the pin, yell an emphatic “fire in the hole” and lob the grenade into the sleeper’s room. After ten seconds a very annoying and piercingly loud noise (there are three volume settings) will blast out from the alarm. That’s not all however, what makes this especially great is that to stop the alarm the sleeper has to find you so you can put the pin back in. Price: $16

If somebody wakes me up with an alarm I can’t turn off by myself, that alarm’s going to keep on ringing—in my septic tank.

UPDATE: If the person who used the alarm on me wants to go in after it, he’s welcome to it.

Older women who say talk shows and soap operas are their favorite TV programs tend to score more poorly on tests of memory, attention and other cognitive skills, researchers reported Monday.

That doesn’t mean that daytime television is a brain drain, they say, since it’s not clear that there’s a direct relationship between the two.

But the findings do point to some association between TV choices and intellectual function, and that could prove useful in evaluating older people for cognitive decline, according lead investigator Dr. Joshua Fogel of Brooklyn College of the City University of New York.

A study of 289 older women without dementia found that those who rated talk shows and soaps as their favorite programs performed more poorly on tests of memory, attention and mental quickness than their peers who cited other types of shows.

What’s more, they were at greater risk of showing signs of clinical impairment. For example, compared with women who preferred to watch news programs, those who favored soaps were more than seven times more likely to show signs of impairment on one of the tests, while talk show fans were more than 13 times more likely to demonstrate impairment.

“Those findings are quite robust,” Fogel told Reuters Health.

I’ve long believed one has to be a moron to want to watch those daytime blatherfests. These findings can, I believe, add new meaning to the term, “Oprah-fication of America.”

With the passing of the third anniversary of the downfall of Ba’athism in Iraq—which would have seen one of Saddam’s sweet young sons succeed him after another ten or twenty years of his rule—the “chickenhawk” meme is reappearing in moonbat comments throughout blogdom.

You know the rules: you have to down a shot every time this happens.

But if you haven’t had breakfast yet, you may delay until after the Rice Krispies stop talking.

Quark’s idiot brother is at it again.

On the House side, DCCC chairman Rahm Emanuel, he of the ballet and Clinton Administration career track, says his candidates will be attacking “rubber stamp Republicans” at a time when Republicans in the House and Senate are anything but. Emanuel thinks so much of the moniker that his staff says that he has trademarked the name “Rubber Stamp Congress.” We expect to see it on coffee mugs and T-shirts across the nation.

Emanuel briefed reporters on the DCCC plans last week, and called Republicans “rudderless” and “divided.”

Which is it, Rahm—are they “rubber stamp” Republicans, marching in lockstep with George W. Bush and Darth Rove, or are they “rudderless and divided” Republicans all each going their own way?

“We don’t have to have specific policy ideas or positions,” says a DCCC staffer. “Rahm is taking a bigger picture approach to our candidates. We’ll give them themes to play off of, but we think the best candidates will take those themes and create local issues and initiatives that catch the attention of the specific voting block they are trying to attract.”

When asked about running against the war, the staffer said, “That goes without saying, unless they are in a district that tends to run counter to that notion.”

So much for tough stands.

What do you expect from a Ferengi, anyway?
